IN NO EVENT SHALL GABORPOST'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO GABORPOST IN THE LAST TWELVE (12) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless GaborPost and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of GaborPost.com; (c) your User Content; (d) your violation of any rights of another party, including any intellectual property rights; or (e) your violation of any applicable laws or regulations.

GaborPost reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with GaborPost in asserting any available defenses.

11. Termination and Suspension

We may terminate or suspend your account and access to GaborPost.com immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease, and you must cease all use of GaborPost.com.

You may terminate your account at any time by discontinuing your use of GaborPost.com and, if applicable, deleting your account through the account settings. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.

These Terms and your use of GaborPost.com shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

You and GaborPost agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or GaborPost.com through good faith negotiations. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue available legal remedies.

13. Miscellaneous Provisions

These Terms constitute the entire agreement between you and GaborPost regarding your use of GaborPost.com and supersede all prior agreements and understandings, whether written or oral. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
